Late last night, Penang Govt quickly hold PC to again claim that they did no overpay for the studies - probably hoping that Rahman Dahlan and the BNSC team will be busy celebrating Hari Raya and not reply so soon.

Interestingly, both Lim Guan Eng and Penang EXCO for infrastructure just sit down and ask Chow Kon Yeow to explain.

Choiw did a really poor job in explaining and ended up confirming the following::

1. There was overpayment - but they claim it is only 17.6% overpayment and not 400% overpayment.

2. Chow claimed that their actual fees that they paid for civil and structural fees is only RM64 million and the rest of the RM177.5 million fees for this part is to pay for other surveys and design work - many of which is already in the scope of the feasibility studies where an additional RM31.2 mil was already paid too.

3. Chow confirmed that full payment of RM209 million for consulting fees for the 3 roads was already made despite guidelines saying that they should not make it full payment if construction has not started. Chow however failed to explain why full payment was already made for the EIA since public consultations on the 3 highways have not been completed and the EIA passed.

4. He admitted that this did not go thru an open tender but a Request for Proposal exercise - where costs are heard to compare.

The above are among many areas that Chow screwed up in explaining. Let's wait for the reply from the BNSC team - probably tomorrow or day after but surely not on first day of Raya.  It will be interesting.

The total cost confirmed paid so far by the Penang Government is RM209 million for consultancy fees for the 3 roads totaling 20km in length comprises of RM31.2 million for the feasibility study and RM177.5 million for the detailed design cost.

It is this RM177.5 million cost that the Board of Engineers and the Works Minister say is 400% over-priced.

In his attempt to justify this RM177.5 million in cost two days ago, YB Chow Kon Yeow said this fee is for a wide scope comprising of various other studies and reports - including the Detailed Environmental Impact Assessment (DEIA).

In his press-conference and statement, YB Chow Kon Yeow had claimed the cost that they paid was only 17.6% over-priced but not 400% over-priced.

However, in the 2016 Penang PAC report on the tunnel, it was specifically stated that this RM177.5 million does not include the cost of the DEIA.

In his 22nd May 2017 answer to the Penang State Assembly, Penang EXCO YB Lim Hock Seng also confirmed that a total of RM220 million have been paid and this cost specifically does not include the DEIA.

So now, the question is if YB Lim Hock Seng had misled the State Assembly or is YB Chow Kon Yeow trying to mislead the public in trying to justify a 400% overpayment?

As for the other reports and surveys listed by YB Chow Kon Yeow, the BNSC is of the opinion that many of these reports and surveys listed by are all sub-components of the feasibility study and detailed design costs, which the Penang State Government had fully paid for - and deemed way over-priced.

For example, how is it possible for you to complete a feasibility study if there was no land survey or financial feasibility study, traffic impact study done?

What kind of civil and structural engineering services would not include the land tunnel design or mechanical and electrical design architecture design?

The Penang Government should stop lying to the public and admit that the RM11 million per kilometer in pre-construction fees are highly over-priced.

Please also note that the pre-construction fees are on top of the high construction cost stated by the Penang State Government such as:

The Lebuhraya Tun Dr Lim Chong Eu to Air Itam bypass of 5.70km length costing RM851 million - or RM149 million per km

The Lebuhraya Tun Dr Lim Chong Eu to Persiaran Gurney bypass of 4km in length costing RM757.9 million - - or RM189 million per km.
