UNSPIN: Glaring mistakes in the Mystery Letter II


There serious glaring mistakes on the Mystery Letter highlighted in Jebat Must Die article Letter from good MACC officers accusing the bad MACC officer. Excerpts are as below:

Well, the letter said that this officer, Hishamuddin left the building at 6.10 in the morning. The letter specifically said that he left the building at 6.10am but without punching out his punch card (MACC office still using punch card? How retro is that?)

This is what the letter said:

“Kami mengesyaki berdasarkan maklumat yang diperolehi bahawa TP tidak mengetuk kad perakam waktunya (punch-card) semasa beliau hendak balik daripada pejabat pada 16hb Julai 2009, jam 6.10 pagi. Ini penting kerana ia boleh membuktikan bahawa TP adalah orang yang terakhir melihat Teoh. Persoalannya, kenapa beliau tidak mengetuk kad perakamnya sedangkan beliau adalah seorang yang selalu mengetuk kadnya. Untuk rekod, beliau adalah seorang yang teliti dengan kad perakamnya.”

Anyway, the writers of the letter knew that Hishamuddin had gone back from the office that morning. They actually saw him going back home although he did not do the obligatory punch-out. It is quite peculiar for them to say that. Because, this immediately absolves Hishamuddin from ever been at the point of TBH’s death because according to experts, TBH time of death is from 8am to 9.30am.

Hmmm.. as we all know, one of the last person to see Teoh Beng Hock was Tan Boon Hwa and this was admitted by the latter who made the declaration that around 6am to 6.30am, he saw Teoh Beng Hock looking ‘tired and quiet’ in the pantry.

However, there is also one big point of contention in the letter when it had seriously accused Hishamuddin of tampering with the crime scene i.e. the window on the 14th floor of Plaza Masalam.

It stated:

“Kami mendapat maklumat bahawa TP telah mengarahkan pegawai bawahannya untuk mengelap/mengesat kesan cap c(j)ari pada tingkap tingkap yang dipercayai tempat Teoh jatuh. Ini terbukti apabila pihak polis tidak menjumpai apa0apa kesan cap jari baru atau lama pada tingkap tersebut. Persoalannya, kenapa TP mengarahkan untuk bertindak sedemikian?“

Now, I find this piece of information quite odd because in the Inquest, we were told that there were fingerprints near the window. The investigators at the crime scene were grilled by Gobind himself at that time and it was revealed that there were as many as 8 fingerprints near the window sill.

Now if Hishamuddin had asked his subordinates to wipe clean the window, how come there are still fingerprints? Okay, lets give the benefit of the doubt that the subordinates had wiped the window halfheartedly (because these probably were the subordinates with conscience and good heart we mentioned earlier).

But how come the window, as testified by the investigators in the inquest as dirty and dusty? The reason why they cannot figure out the fingerprints was because of the dusty and dirty window sill.

Remark: Only a pariah lawyer and helped by a corrupted judge and prosecutor will ever take such surat layang seriously.

    Your brains must be at your backside to accuse YB Gobind to be a pariah lawyer--whole Malaysia knows who is YB Gobind--the Tiger of Puchong. What do you expect the writer-- to sign is it and end up like the High Court judge Syed Aidid--who had accused 112 judges as corrupt--is it. Every body in Malaysia--except people like you who bodek the BN govt-know that whistleblowers will be caught and treated like a criminal.You talking about corrupted judges--the whole world knows from the Linggam video scandal that--most of the judges are corrupt to the core--even the CJ can be bought with money and gifts. What Syed Aidid wrote was right--but he was forced to resign. A TIM's survey has also revealed that 99% of the lawyers have negative opinion about the Malaysian judiciary and also the PDRM--now who is the pariah--you make your own conclusion.

    To me the said letter was conjured up by 'someone' linked to or having a personal interest in the case. It had a very dramatic effect, one which we sometimes see on TV dramas. The timing of the letter when introduced, the relevancy of certain incidents, the irregularities of facts, seems to prove the aforesaid point.

    The fact that the letter was unsigned can be construed as :
    1. well, he/she wants to remain
    anonymous ( a safeguatd factor)
    2. the writer can't be identified and
    therefore safe to make any wild
    allegation.
    3. wanting to raise benefit of doubt
    to certain personalities involved or
    to certain prior statements made

    My personal feeling is the Coroner should not entertain this kind of 'Surat Layang' for if it should be a precedent, then can you just imagine the chaos it will cause when officers of the court, defence or prosecution, have to deal with this influx ! And as humans, we will end up supporting one when it serves our case and the next moment being a hypocrite when it does not ! Question , can an unsigned 'Surat Layang' be admissible in court as evidence ? Please enlighten !

    On another note, one doesn't have to be 'a Tiger', nor a politician nor an intellectual nor a professional to be part of a conspiracy, any kind of conspiracy for that matter.

    Is there a conspiracy here ???? How about vested-interest ?? How about blind affiliation ?

    pointing out the obvious,
    do punch out translated to malay means 'mengetuk'?

    doesn't seems right to me and it's sounds like a direct translation usually happen in the cinema.

    This kind of words would mean a big 'KETUK' on my head by my beloved former Bahasa Malaysia teacher back in school day. 'Daftar keluar' would sound much nicer, the letter seems to be made in a hurry or being writen under pressure.

    The last time, accusation being thrown at each other was using SD. Now we should expect lots of 'surat layang' to be out soon if this is accepted by the courts of law. This unsigned letter would be academic if it is accepted in the courts of law and will be started to be used again and again in the future massively.

    If it is true that the fella want to correct the wrong, he should step up and be a witness. Don't let another this to be another altantuya case where RPK and Anwar say they hold the key to prove that Najib is credible to the case but held it back while the prosecution of the current 'tertuduh' is on going. Is that fair?

    if I may add to the comment from spanner.

    if 99% of lawyers did have negative opinions on Malaysia's PDRM and judiciary, how are they still practice law here in Malaysia? Isn't it frustrating to work against the system?

    and what is TIM? is the lawyer they pooled is from the lawyer in parti keadilan?

    Penulis surat layang ni tidak berapa fasih dalam Bahasa Melayu.

    Ada beberapa perkataan yang janggal. Penyusunan ayat pun kekok.

    Adakah ia ditulis oleh pegawai Melayu - tidak meyakinkan.

    Lagipun terlalu banyak fakta yang tidak ada kena mengena dengan kes Teoh Beng Hock.
