Ill Lead Counsel Discharges Himself From Representing Anwar
KUALA LUMPUR, July 15 (Bernama) -- Lawyer Sulaiman Abdullah, who is under treatment in hospital for a bout of giddiness, has temporarily discharged himself from representing Datuk Seri Anwar Ibrahim as the lead counsel in his sodomy case, forcing High Court Judge Datuk Mohamad Abidin Mohd Diah to adjourn proceedings to 2pm Wednesday.
S.N. Nair, one of Anwar's other counsel, told reporters Sulaiman informed the defence team that he did not want the case to be delayed because of his health condition. Sulaiman was admitted to the Kuala Lumpur Hospital last week for treatment of giddiness.
At the outset of today's proceedings in open court at 9.15am, Anwar's counsel Edmund Bon and R. Sivarasa and Solicitor-General II Datuk Mohamed Yusof Zainal Abiden, who is leading the prosecution team, adjourned to Judge Mohamad Abidin's chambers.
Nair informed the media that the defence had applied to adjourn today's proceedings to enable Anwar to appoint a new counsel but that the request was not granted.
He said the judge had asked one of the counsel to represent Anwar in today's proceedings and had adjourned the case to 2pm.
Anwar, 61, is charged with sodomising his former personal aide, Mohd Saiful Bukhari Azlan, 23, at Unit 11-5-1, Desa Damansara Condominium, Jalan Setiakasih, Bukit Damansara, here between 3.01pm and 4.30pm on June 26 last year.
The court had fixed today to hear Anwar's application for documents as well as for the mention of another of Anwar's applications to strike out the sodomy charge against him and for mention of the sodomy trial.
Nair said Sulaiman was the most senior counsel with more than 30 years experience in the legal service compared to the eight other counsel who were juniors in the team.
He said the judge's order to proceed with the case today without giving an opportunity for Anwar to appoint a new counsel had deprived Anwar of his right to choose a counsel of his choice under Article 5 of the Federal Constitution.
"If a new counsel takes over, the case should be postponed for one or two weeks also to enable the counsel to prepare the case," he said.
Anwar told reporters Sulaiman informed him at 6pm yesterday to appoint a new lead counsel to represent him, not only in this case but also in all of his other cases.
Selangor Menteri Besar Tan Sri Abdul Khalid Ibrahim was also present in court today.
